  1. Introduction
    1. In processing the personal data of the Container Store’s Users and Consumers, the Seller proceeds from the principles of lawfulness, minimality, purposefulness, and transparency. This means that the Seller processes personal data as little as possible and as much as required, does so only based on legal bases deriving from law and for lawful purposes, and informs data subjects of both the methods and purposes of processing their data.

    2. Questions and applications related to processing of personal data can be filed with the Seller by e-mailing scanmarine@scanmarine.ee. In the case of complaints, Users and Consumers can also contact the Estonian Data Protection Inspectorate.

  2. Definitions
    1. The Seller is ScanMarine Estonia OÜ (reg. No. 12387797, address Tööstuse 47d-15, 10416 Tallinn, Estonia; tel. +372 650 5330, e-mail scanmarine@scanmarine.ee).

    2. Container Store https://scanmarine.ee/pood/ is an e-store that operates at as run by the Seller.

    3. Policy is this Privacy Policy for ScanMarine Container Store.

    4. The User is a natural person that reviews goods offered at Container Store and thereat prepares an order for and on behalf of the Customer.

    5. The Customer is a natural person or legal person defined in an order.

    6. The Consumer is a Customer that is a natural person and purchases goods to be used for purposes unrelated to their professional or commercial activity and whose residence is in Estonia or in another European Union member state.

    7. Cookie is a small text file which is saved on the User’s computer or mobile phone during the relevant visit to the Container Store.

    8. Data protection laws are the General Data Protection Regulation1, the Republic of Estonia Personal Data Protection Act2, and other applicable legislation pertaining to protection of personal data.

    9. The terms “personal data”, “data subject”, “processing”, “restriction of processing of personal data”, “profiling”, “controller”, “third party”, “consent” of the data subject, and “international organization” are used in this Policy in their meaning laid down in Article 4 of the General Data Protection Regulation.

  3. Composition of processed personal data

In relation to running of the Container Store, the Seller as a controller processes the following personal data:

        1. the forename and surname, telephone number and e-mail address of the Consumer or the User that represents the Customer;

        2. in the case of consumer sales, information concerning the payment method and payment means selected by the Consumer;

        3. cookies required for functioning of the “WooCommerce” e-store software; and

        4. cookies required to use the “Google Analytics” web analytics service.

  1. Legal basis and purposes of processing personal data
    1. The legal bases for processing data noted in items 3.1.1(a) and 3.1.1(b) are taking of steps prior to entering into a contract and performance of a contract, and performance of the Seller’s lawful obligation; the purposes of processing are preparing the conclusion of a contract and performance of the Seller’s obligations arising from the Republic of Estonia Accounting Act and rules laid down on the basis thereof.

    2. The legal basis for processing data noted in item 3.1.1(c) is taking of precontractual measures; the purpose of processing is ensuring the functionality of the Container Store.

    3. The legal basis for processing data noted in item 3.1.1(d) is the Seller’s legitimate interest in providing users of the Container Store with quality services and user experience; the purpose of processing is monitoring the use of the Container Store so as to enable betterment of the relevant user experience.

  2. Periods of retention of personal data
    1. The Seller retains data noted in items 3.1.1(a) and 3.1.1(b) during the term of the concluded contract and after said term for as long as it is required to prove possible legal claims by the parties to the contract. If such data is also reflected in the Seller’s accounting documents, the Seller retains said data also during the term laid down in the Republic of Estonia Accounting Act and applicable accounting rules.

    2. Data noted in items 3.1.1(c) and 3.1.1(d) are retained in the computer or other device used by the User to visit the Container Store; the User can delete said data from said device at any time as they see fit.

  3. Other terms and conditions of processing personal data
    1. The Seller does not transfer personal data to third parties, third countries, or international organizations.

    2. The Seller does not use personal data for automated individual decision-making or profiling.

  4. Other rights of consumer, user, and seller
    1. The Consumer and the User have the right to submit to the Seller, using the address noted in item 2.1 or an e-mail address, applications requesting from the Seller in cases provided for in data protection laws access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability.

    2. The Seller responds to the application noted in item 7.1 at first reasonable opportunity, yet no later than within one month as from receipt of the application. If possible, the Seller responds to electronically filed applications electronically.

    3. If the Consumer or the User finds that their rights have been violated, they may file a complaint to the Estonian Data Protection Inspectorate whose contact details are available at https://aki.ee/.

    4. The Seller has the right to amend this Privacy Policy at any time. Such amended Privacy Policy becomes applicable upon publication thereof in the Container Store.
